These Terms of Service govern your use of thenexusgnv.com, purchases from The Nexus, and participation in services or events operated by The Nexus Collector Market.
Throughout these Terms, “The Nexus,” “we,” “us,” and “our” refer to The Nexus Collector Market. By accessing our website, placing an order, creating an account, or purchasing from us, you agree to these Terms, our Privacy Policy, Return and Refund Policy, and any additional terms displayed for a particular product, service, promotion, or event.
If you do not agree with these Terms, do not use our website or services.
1. Online Store
Our online store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to offer products and services online.
Your use of Shopify features, Shop Pay, or another third-party payment service may also be governed by that provider’s terms and privacy practices.
2. Customer Eligibility and Accounts
You must be legally capable of entering into a binding agreement to make a purchase. If you are under the legal age of majority, a parent or legal guardian must authorize your purchase.
You agree to provide accurate and complete information when placing an order or creating an account. You are responsible for protecting your account credentials and for activity conducted through your account.
We may refuse service, close an account, cancel an order, or limit purchasing quantities when reasonably necessary to prevent fraud, abuse, unauthorized resale, disruption, or violation of these Terms.
3. Products and Collectibles
We make reasonable efforts to accurately describe and photograph our products. Colors, packaging, labels, and product appearance may vary because of lighting, displays, manufacturer changes, or normal production differences.
Trading cards and collectibles may contain minor manufacturing imperfections. Unless expressly guaranteed in writing, The Nexus does not guarantee:
- The grade, condition, centering, or future grading result of a raw card
- The contents or value of any sealed product
- Specific cards, autographs, memorabilia, or other “hits”
- Manufacturer insertion ratios or product collation
- The future market value, availability, or investment performance of any item
- That exterior collectible packaging will be free from every minor dent, crease, scratch, tear, or wrapping imperfection
Customers should inspect in-store merchandise before purchasing it. The condition of photographed singles and collectibles is based on the listing, description, and images provided.
4. No Investment Advice
Trading cards and collectibles can increase or decrease in value. Product descriptions, prices, market comparisons, social-media posts, and statements made by staff are provided for general information only.
Nothing offered by The Nexus constitutes financial, investment, tax, or legal advice. You are responsible for deciding whether a purchase is appropriate for you.
5. Prices and Availability
Prices, promotions, quantities, and product availability may change without notice. Placing an item in your cart does not reserve it.
We may impose quantity limits or purchase restrictions on high-demand products.
Although we try to provide accurate information, typographical errors, inventory errors, incorrect images, and pricing mistakes may occur. We reserve the right to correct an error and cancel or decline an affected order before fulfillment. If payment has already been collected for a canceled item, the amount collected for that item will be refunded.
Unless expressly stated otherwise, prices do not include applicable taxes, shipping charges, insurance, or other fees.
6. Orders and Payment
Submitting an order is an offer to purchase. An automated order confirmation only confirms that we received the order; it does not guarantee acceptance or fulfillment.
An order is accepted when it is fulfilled, shipped, or otherwise confirmed by The Nexus. We may verify payment, identity, shipping information, product availability, and suspected fraudulent activity before accepting an order.
You represent that you are authorized to use the payment method submitted with your purchase.
7. Preorders and Special Orders
Preorder release dates and expected quantities are estimates supplied by manufacturers or distributors and are not guaranteed.
Manufacturers and distributors may delay releases, reduce allocations, change product configurations, or cancel products. If our allocation is reduced, we may limit quantities or cancel affected orders. Any amount collected for merchandise we cannot provide will be refunded.
Unless otherwise stated:
- Orders containing preorder and in-stock products may be held until every item is available.
- Market-price changes do not entitle either party to a price adjustment after an order has been accepted.
- Preorders and special orders are final sale and may not be canceled by the customer.
- Deposits are nonrefundable unless The Nexus cancels the applicable order.
Additional preorder terms displayed on a product page become part of these Terms.
8. Shipping and Delivery
Shipping and delivery dates are estimates and are not guaranteed. Delays caused by carriers, weather, incorrect addresses, holidays, manufacturers, or events outside our reasonable control do not automatically qualify an order for cancellation or refund.
Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges resulting from an incorrect or incomplete address may be charged to the customer.
Responsibility for lost, stolen, delayed, or damaged packages will be determined using carrier tracking, delivery confirmation, insurance coverage, and applicable law. Customers must cooperate with reasonable carrier investigations.

9. Returns and Refunds
Returns, exchanges, cancellations, damaged orders, and refunds are governed by our posted Return and Refund Policy, which is incorporated into these Terms.
Trading cards, graded cards, sealed trading card products, collectibles, mystery products, promotional products, event purchases, and gift cards are generally final sale.
Opening, altering, tampering with, or removing the original seal from a product makes it ineligible for return.
10. Manufacturer Defects
The Nexus is not responsible for manufacturer printing defects, damaged cards inside factory-sealed products, missing hits, incorrect collation, redemption problems, or failure to receive the manufacturer’s advertised average contents.
These concerns must generally be addressed with the manufacturer. We may provide reasonable proof of purchase when available, but we cannot guarantee that the manufacturer will approve a claim.
11. Events, Vendor Tables, and Promotions
Event dates, hours, layouts, vendor placement, scheduled activities, and participating vendors may change.
Unless otherwise stated, vendor tables, event fees, reservations, sponsorships, promotional purchases, and deposits are final sale and nontransferable without written approval.
Event participants and vendors must follow posted rules and staff instructions. The Nexus may remove or refuse participation to anyone who engages in unsafe, threatening, fraudulent, disruptive, unlawful, or seriously inappropriate conduct. Removal for violating event rules does not create a right to a refund.
Separate vendor, consignment, giveaway, tournament, or promotional terms control when they conflict with these general Terms.
12. Third-Party Marketplaces
Purchases made through eBay, TCGplayer, Whatnot, or another marketplace may also be governed by that platform’s terms.
When a marketplace’s mandatory rules conflict with these Terms, the marketplace’s rules will control that particular transaction to the extent required.
13. Prohibited Uses
You may not use our website or services to:
- Violate applicable law or another person’s rights
- Submit false, misleading, or fraudulent information
- Conduct payment fraud, return fraud, or chargeback abuse
- Introduce malware or interfere with website security
- Scrape, copy, or commercially exploit website content without permission
- Impersonate another person or misrepresent your identity
- Attempt to obtain unauthorized access to an account or system
- Harass employees, vendors, customers, or event participants
- Purchase products through automated means intended to bypass quantity limits
We may suspend access or cancel affected transactions when these rules are violated.
14. Intellectual Property
The Nexus name, logos, branding, website content, graphics, photographs, videos, designs, and original materials are owned by or licensed to The Nexus and are protected by applicable intellectual-property laws.
You may not reproduce, modify, sell, distribute, or commercially use our original materials without written permission.
Product names, characters, artwork, and trademarks belonging to Pokémon, Bandai, Wizards of the Coast, Konami, or other companies remain the property of their respective owners. The Nexus is not affiliated with or endorsed by those companies unless expressly stated.
15. Reviews and Customer Content
If you submit a review, photograph, comment, testimonial, or other content to The Nexus, you confirm that you have the right to submit it and that it is not unlawful, deceptive, defamatory, infringing, or malicious.
You grant The Nexus a nonexclusive, royalty-free right to use, reproduce, and display submitted content in connection with our business and marketing, unless prohibited by law or otherwise agreed in writing.
We may remove content that violates these Terms.
16. Third-Party Links and Services
Our website may link to third-party websites, applications, payment providers, or social-media services. The Nexus does not control and is not responsible for third-party content, availability, security, products, or privacy practices.
Your use of a third-party service is at your own discretion and may be governed by separate terms.
17. Disclaimer of Warranties
To the fullest extent permitted by law, our website, products, content, and services are provided on an “as available” basis without warranties not expressly stated in writing.
We do not guarantee that the website will always be uninterrupted, secure, accurate, or error-free.
Nothing in this section excludes warranties or consumer rights that cannot legally be waived.
18. Limitation of Liability
To the fullest extent permitted by law, The Nexus and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website, products, services, or events.
For a claim relating to a particular transaction, our total liability will not exceed the amount the customer paid to The Nexus for the product or service giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold The Nexus harmless from third-party claims, losses, or reasonable expenses arising from your unlawful conduct, violation of these Terms, infringement of another person’s rights, or misuse of our website or services.
20. Governing Law and Venue
These Terms and transactions with The Nexus are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes must be brought in a court of competent jurisdiction located in Alachua County, Florida.
Nothing in these Terms prevents either party from pursuing a remedy available through an appropriate small-claims court.
21. Electronic Transactions
By using our website and submitting an order electronically, you consent to conducting the transaction by electronic means.
Electronic orders, confirmations, notices, and records may satisfy legal requirements that a communication or agreement be in writing, subject to applicable law.
This section is intended to operate consistently with the Florida Uniform Electronic Transaction Act, Florida Statute § 668.50. View Florida Statute § 668.50.
22. Policy Changes
We may update these Terms to reflect changes in our business, services, technology, or legal obligations.
Updated Terms will be posted with a revised effective date. Changes apply prospectively unless applicable law permits otherwise. Continuing to use the website after updated Terms become effective constitutes acceptance of those updated Terms.
23. Severability and Waiver
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.
Failure to enforce a provision on one occasion does not waive the right to enforce it later.
24. Entire Agreement
These Terms, together with our posted Privacy Policy, Return and Refund Policy, Shipping Policy, and any transaction-specific terms, constitute the agreement between you and The Nexus concerning your use of our website and services.
